Plain English

K.A.R. 28-72-1e establishes a set of standardized definitions that apply throughout Kansas's lead-based paint regulations. Key terms defined include 'EBL child' (a child with a confirmed blood lead concentration of 10 micrograms per deciliter or higher), 'encapsulant' (a liquid-applied or adhesively bonded material that creates a barrier over lead-based paint), 'encapsulation' (the act of applying such a material), 'enclosure' (as defined by the referenced federal regulation), and 'EPA' (the United States Environmental Protection Agency). These definitions work alongside those in K.S.A. 65-1,201 to create a consistent vocabulary for interpreting and applying the broader regulatory framework.

For Property Managers

Property owners and managers operating under Kansas's lead-based paint rules should be familiar with the definitions set out in K.A.R. 28-72-1e, as these terms carry precise regulatory meanings that govern compliance obligations throughout K.A.R. 28-72. For example, understanding what qualifies as an 'encapsulant' or 'encapsulation' is important when evaluating approved methods for addressing lead-based paint hazards. Compliant operators generally ensure that any remediation or disclosure activities align with these defined terms rather than relying on informal or colloquial interpretations.

For Tenants

Tenants living in housing subject to Kansas lead-based paint regulations benefit from understanding the definitions established in K.A.R. 28-72-1e, particularly the threshold that defines an 'EBL child' — a confirmed blood lead level of 10 micrograms per deciliter. If a child in a household is identified as an EBL child, this regulatory definition may trigger specific obligations for property owners under the broader K.A.R. 28-72 framework. Tenants who have concerns about lead hazards or a child's blood lead levels may find it useful to contact a local tenant-rights organization or the Kansas Department of Health and Environment to understand what protections and remedies may be available.
