Kan. Admin. Regs. 21-60 § K.A.R. 21-60-9
Discrimination in the provision of brokerage services.
Operative Text
Unlawful practices under K.S.A. 44-1016(f) include, but are not limited to: (a) Setting different fees for access to or membership in a multiple listing service based on race, religion, color, sex, disability, familial status, national origin or ancestry; (b) Denying or limiting benefits accruing to members in a real estate brokers' organization because of race, religion, color, sex, disability, familial status, national origin or ancestry; (c) Imposing different standards or criteria for membership in real estate sales or rental organization based on race, religion, color, sex, disability, familial status, national origin or ancestry; and (d) Establishing geographic boundaries, office location or residence requirements for access to or membership or participation in any multiple listing service, real estate brokers' organization or other service, organization or facility relating to the business of selling or renting real property because of race, religion, color, sex, disability, familial status, national origin or ancestry.
K.A.R. 21-60-9 identifies specific forms of discrimination in real estate brokerage services that are unlawful under K.S.A. 44-1016(f). The rule prohibits differential treatment in multiple listing service fees, membership benefits, membership standards, and geographic access requirements when that treatment is based on protected characteristics such as race, religion, color, sex, disability, familial status, national origin, or ancestry. These prohibitions apply to real estate brokers' organizations and any related services or facilities involved in selling or renting property.
Plain English — not legal advice.
Property owners and managers who participate in real estate brokers' organizations or multiple listing services should be aware that K.A.R. 21-60-9 holds those organizations to strict nondiscrimination standards. Compliant operators generally ensure that any MLS or brokerage organization they work with applies uniform fee structures, membership criteria, and access policies regardless of a member's or client's protected characteristics. Operators who encounter differential treatment based on race, religion, color, sex, disability, familial status, national origin, or ancestry within such organizations may have grounds to raise a concern under this provision.

K.A.R. 21-60-9 protects individuals from discriminatory practices within the real estate brokerage infrastructure that shapes access to housing listings and services. If a tenant or prospective buyer believes they have been affected by discriminatory MLS fees, unequal membership benefits, or geographic restrictions tied to a protected characteristic, they may consider filing a complaint with the Kansas Human Rights Commission or consulting a tenant-rights organization familiar with K.S.A. 44-1016(f). Multiple enforcement and advocacy paths exist, and individuals can explore which avenue best fits their circumstances.
