Kan. Admin. Regs. 21-60 § K.A.R. 21-60-10
Unlawful practices under K.S.A. 44-1017(a) include, but are not limited to, failing or refusing to provide to any person, in connection with a residential real estate-related transaction, information regarding the availability of loans or other financial assistance, application requirements, procedures or standards for the review and approval of loans or financial assistance, or providing information which is inaccurate or different from that provided others, because of race, religion, color, sex, disability, familial status, national origin or ancestry.

Plain English

K.A.R. 21-60-10 clarifies what counts as an unlawful practice under K.S.A. 44-1017(a) in the context of residential real estate financing. Specifically, it identifies withholding, refusing to share, or providing inaccurate or inconsistent information about loan availability, application requirements, or approval standards as prohibited conduct when that conduct is motivated by a person's race, religion, color, sex, disability, familial status, national origin, or ancestry. The rule makes clear that unequal or misleading treatment in the flow of financial information—not just outright loan denial—can constitute illegal discrimination.

For Property Managers

Property owners and managers who work with lenders or refer prospective buyers or tenants to financing options should be aware that K.A.R. 21-60-10 extends fair-housing obligations into the informational aspects of real estate transactions. Compliant operators ensure that all parties receive the same accurate information about loan products, application procedures, and approval criteria, regardless of protected characteristics. Maintaining consistent, documented communication practices around financing information is a hallmark of operations that align with K.S.A. 44-1017(a) and its implementing regulations.

For Tenants

Under K.A.R. 21-60-10, individuals have a right to receive the same accurate information about loans and financial assistance in residential real estate transactions as anyone else, without regard to race, religion, color, sex, disability, familial status, national origin, or ancestry. If a person believes they were given incomplete, inaccurate, or different financing information compared to others because of a protected characteristic, that experience may constitute an unlawful practice under K.S.A. 44-1017(a). General enforcement paths can include filing a complaint with the Kansas Human Rights Commission, contacting the U.S. Department of Housing and Urban Development, or reaching out to a local tenant-rights or fair-housing organization for guidance.
