Plain English

Iowa Admin. Code r. 161—9 § 161—9.27 establishes two parallel appeal tracks for rulings made by a presiding officer during the discovery phase of proceedings. When a presiding officer imposes sanctions related to discovery under rule 161--9.16(216), the appeal follows the same procedural path as appeals governed by rule 161--4.23(17A). For all other discovery-related decisions by the presiding officer, the appeal is handled according to the procedures set out in rule 161--4.25(17A).

For Property Managers

Under Iowa Admin. Code r. 161—9 § 161—9.27, property owners or managers involved in administrative proceedings before the Iowa Civil Rights Commission should be aware that discovery-related rulings—including any sanctions—are subject to specific appeal procedures. Operators who receive an adverse discovery ruling generally track whether it involves a sanction under rule 161--9.16(216) or falls into the broader category of other decisions, since each category follows a different procedural framework. Maintaining organized records of all presiding officer rulings during discovery helps ensure that any appeal is filed through the correct channel and in a timely manner.

For Tenants

Iowa Admin. Code r. 161—9 § 161—9.27 provides a defined appeals process for tenants or complainants who receive an unfavorable discovery ruling during administrative proceedings. If a presiding officer imposes discovery sanctions, the appeal path mirrors the procedures under rule 161--4.23(17A), while other discovery decisions are appealed under the framework of rule 161--4.25(17A). Individuals navigating this process may benefit from consulting a tenant-rights organization or legal aid provider familiar with Iowa Civil Rights Commission procedures to understand which appeal track applies to their situation.
