Operative Text
9.21(1) When the deposition is transcribed, the investigator or other officer shall certify on the deposition that the witness was duly sworn and that the deposition is a true record of the testimony given by the witness. Documents and things produced for inspection during the deposition shall, upon the request of the investigator, be marked for identification and annexed to the deposition, except that: a. The person producing the materials may substitute copies to be marked for identification, if the investigator is provided fair opportunity to verify the copies by comparison with the originals; b. If the person producing the materials requests their return, the investigator shall mark, copy, and, at some time prior to the completion of the investigation, return them to the person producing them. The materials may then be used in the same manner as if annexed to the deposition. 9.21(2) Upon payment of reasonable charges therefor, the commission shall furnish a copy of the deposition to the party who was deposed or to the deponent.
Iowa Admin. Code r. 161—9 § 161—9.21 establishes the process for certifying, handling, and distributing deposition records in civil rights investigations. Once a deposition is transcribed, an officer must certify that the witness was properly sworn and that the transcript accurately reflects the testimony given. Documents produced during the deposition are marked and attached to the record, though originals may be substituted with copies or returned to the producing party under specified conditions, and either party may obtain a copy of the deposition from the commission upon paying reasonable charges.

Under Iowa Admin. Code r. 161—9 § 161—9.21, property owners or managers who produce documents during an investigative deposition should be aware that those materials will generally be marked for identification and annexed to the deposition record. If originals are submitted, a request for their return can be made, provided the investigator is given a fair opportunity to compare copies against the originals before they are returned. Operators who participated in a deposition may obtain their own copy of the transcript from the commission by paying the applicable reasonable charges.
