Iowa Code ch. 562A § 562A.10
Effect of unsigned or undelivered rental agreement
Operative Text
1. If a landlord does not sign and deliver a written rental agreement signed and delivered to the landlord by the tenant, acceptance of rent without reservation by the landlord gives the rental agreement the same effect as if it had been signed and delivered by the landlord. 2. If a tenant does not sign and deliver a written rental agreement signed and delivered to the tenant by the landlord, acceptance of possession without reservation gives the rental agreement the same effect as if it had been signed and delivered by the tenant. 3. If a rental agreement given effect by the operation of this section provides for a term longer than one year, it is effective only for one year.
Iowa Code § 562A.10 addresses what happens when a written rental agreement is not formally signed and returned by one of the parties. Under this provision, a landlord who accepts rent without reservation after receiving a tenant-signed agreement is treated as though the landlord also signed it, and a tenant who takes possession without reservation after receiving a landlord-signed agreement is treated as though the tenant also signed it. If the agreement that takes effect this way specifies a term longer than one year, it is legally capped at one year.
Plain English — not legal advice.
Under Iowa Code § 562A.10, property owners and managers should be aware that accepting rent payments without objection can bind them to the full terms of a written rental agreement, even if they never formally countersigned and returned it. Compliant operators typically review any tenant-submitted agreement before accepting payment, and they communicate any reservations or objections promptly rather than cashing or depositing rent without comment. Keeping clear records of when agreements were signed, delivered, and accepted helps demonstrate the intended terms of the tenancy.

Iowa Code § 562A.10 means that a tenant who moves into a unit and takes possession without objection may be bound by the terms of a written agreement the landlord delivered, even if the tenant never formally signed and returned it. Tenants should understand that their conduct—particularly taking possession—can carry legal weight similar to a signature. Those who have questions about whether an unsigned or undelivered agreement applies to their tenancy may find it helpful to consult a tenant-rights organization or legal aid office familiar with Iowa landlord-tenant law.
