Cal. Civ. Code § 36-7-9-6
Modification or rescission of orders
Operative Text
Sec. 6. (a) The enforcement authority may issue an order that modifies the order previously issued. (b) The enforcement authority may rescind an order previously issued, even if the order has been affirmed by the hearing authority. As added by Acts 1981, P.L.309, SEC.28. Amended by P.L.59-1986, SEC.6.
Indiana Code § 36-7-9-6 establishes that the local enforcement authority retains ongoing power over orders it has previously issued. Specifically, it may issue a new order that changes or updates an earlier one, and it may also cancel a prior order entirely—even if that order was already upheld by a hearing authority. This flexibility allows the enforcement process to adapt to changed conditions or new information without being locked into earlier determinations.
Plain English — not legal advice.
Under Ind. Code § 36-7-9-6, a property owner who has received an enforcement order should be aware that the order is not necessarily final in its original form. The enforcement authority can revise the requirements of an outstanding order or withdraw it altogether, regardless of whether a hearing body has already affirmed it. Operators generally stay in communication with the enforcement authority and document any changes to orders in writing to maintain a clear compliance record.

Ind. Code § 36-7-9-6 means that an enforcement order affecting a rental property can be changed or cancelled by the enforcement authority at any stage, even after a formal hearing has upheld it. Tenants who are relying on an active order—for example, one requiring a landlord to make repairs—should be aware that the order's status can shift. Tenants may wish to monitor the status of any relevant orders through the local enforcement authority and can consult a tenant-rights organization to understand what options are available if an order is modified or rescinded.
