Plain English

Indiana Code § 36-7-9-1 defines the geographic and governmental scope of the chapter dealing with unsafe building enforcement. By default, the chapter's rules apply to every consolidated city and its associated county. Other municipalities or counties can also bring themselves under the chapter's authority by passing a local ordinance as described in section 3 of the same chapter.

For Property Managers

Property owners and managers operating in Indiana should be aware that Ind. Code § 36-7-9-1 determines whether the unsafe building enforcement chapter governs their locality. Landlords in consolidated cities and their counties are automatically subject to this chapter's requirements. Those operating in other municipalities or counties should check whether a local ordinance has been adopted under section 3, since that adoption would extend the chapter's obligations to their properties as well.

For Tenants

Ind. Code § 36-7-9-1 establishes which communities fall under Indiana's unsafe building enforcement framework, which can be relevant to tenants dealing with substandard housing conditions. Tenants in consolidated cities and their counties are automatically covered, while those in other localities may be covered if their municipality or county has adopted an ordinance under section 3. Tenants seeking to understand whether these protections apply to them can contact their local government offices or a tenant-rights organization for general guidance.
