Cal. Civ. Code § 36-7-18-27
Persons ineligible as tenants
Operative Text
Sec. 27. (a) Officers and members of the authority other than the resident manager are not eligible as tenants under this chapter. This section may not be construed to prevent an existing tenant from being appointed to the housing authority board. However, employees of the authority are eligible as tenants under this chapter. (b) Employees of the United States, the state, and their political subdivisions and agencies may not comprise more than twenty-five percent (25%) of the tenants in a housing project. (c) This section does not limit the power of an authority to vest rights in an obligee under section 33 of this chapter free from all the restrictions imposed by this section. As added by Acts 1981, P.L.309, SEC.37. Amended by P.L.341-1985, SEC.1; P.L.14-1991, SEC.25; P.L.324-1995, SEC.1.
Indiana Code § 36-7-18-27 establishes eligibility rules for tenancy in public housing projects administered by a local housing authority. Officers and board members of the authority itself are barred from becoming tenants, though an existing tenant who is later appointed to the board is not automatically disqualified. Employees of the authority may be tenants, but government employees at the federal, state, or local level collectively cannot make up more than 25% of the residents in any single housing project.
Plain English — not legal advice.
Housing authority administrators operating under Ind. Code § 36-7-18-27 generally maintain tenant eligibility screening procedures that track the occupational status of applicants, particularly distinguishing between authority officers or board members (who are ineligible) and authority employees (who are eligible). Compliant operators also monitor the proportion of government employees across a project to ensure that group does not exceed the 25% cap. Recordkeeping practices that document applicant affiliations with government entities help demonstrate ongoing compliance with these occupancy restrictions.

Under Ind. Code § 36-7-18-27, tenants who are employees of a housing authority retain their eligibility for public housing, and a current tenant who is appointed to the housing authority board is not required to vacate solely because of that appointment. Tenants who believe they have been improperly denied housing or displaced based on a misapplication of these eligibility rules may wish to contact the housing authority directly to request a review of the determination. Tenant-rights organizations or legal aid services familiar with Indiana public housing law can help individuals understand the options available when eligibility decisions are disputed.
