Cal. Civ. Code § 36-1-24-7
"Short term rental platform"
Operative Text
Sec. 7. As used in this chapter, "short term rental platform" means an entity that: (1) provides a platform through which unaffiliated parties offer to rent a short term rental to an occupant; and (2) collects consideration for the rental from the occupant.
Ind. Code § 36-1-24-7 establishes the legal definition of a 'short term rental platform' for purposes of Indiana's short-term rental regulatory framework. Under this definition, a qualifying entity must both operate a marketplace where independent, unaffiliated parties list short-term rentals for occupants and handle the collection of payment from those occupants. This definition determines which businesses fall within the scope of the chapter's rules and obligations.
Plain English — not legal advice.
Property owners who list their short-term rentals through online marketplaces should be aware that those marketplaces may qualify as 'short term rental platforms' under Ind. Code § 36-1-24-7 if they facilitate listings by unaffiliated parties and collect rental payments. Understanding whether a platform meets this statutory definition can be relevant to determining which regulatory requirements apply to transactions conducted through that platform. Operators generally keep records of which platforms they use and how payments are processed, as these details may bear on compliance obligations under the broader chapter.

Ind. Code § 36-1-24-7 defines the type of online booking service—one that hosts listings from independent parties and collects payment—that qualifies as a 'short term rental platform' under Indiana law. Knowing whether the service through which you booked a short-term rental meets this definition may be relevant to understanding what protections or rules apply to your rental arrangement. Tenants with questions about their rights in short-term rental situations may find it helpful to consult a tenant-rights organization or review the full chapter of Indiana law for context.
