Cal. Civ. Code § 36-1-24-6
"Short term rental"
Operative Text
Sec. 6. (a) As used in this chapter, "short term rental" means the rental of: (1) a single family home; (2) a dwelling unit in a single family home; (3) a dwelling unit in a two-family or multifamily dwelling; or (4) a dwelling unit in a condominium, cooperative, or time share; for terms of less than thirty (30) days at a time through a short term rental platform. The term includes a detached accessory structure, including a guest house, or other living quarters that are intended for human habitation, if the entire property is designated for a single family residential use. (b) The term does not include property that is used for any nonresidential use. For purposes of section 1 of this chapter, the term does not include a private, owner occupied business with two (2) to ten (10) guest rooms where overnight accommodations and a morning meal are provided to the public for compensation and that is operated primarily as a business.
Indiana Code § 36-1-24-6 establishes the legal definition of 'short term rental' for purposes of Chapter 24. Under this definition, a short term rental covers a wide range of residential dwelling types—including single-family homes, units in multi-family buildings, condominiums, cooperatives, and time shares—when rented for fewer than 30 consecutive days through a short term rental platform. Detached accessory structures like guest houses are also covered if the overall property is designated for single-family residential use. The definition explicitly excludes nonresidential properties and small owner-occupied bed-and-breakfast-style operations with two to ten guest rooms that serve a morning meal.

Property owners operating or considering short term rentals in Indiana should be aware that Ind. Code § 36-1-24-6 broadly defines which residential property types fall under the state's short term rental framework, including accessory structures on single-family lots. Operators of small, owner-occupied lodging businesses that provide two to ten guest rooms with a morning meal may fall outside this definition and the regulations tied to it. Compliant operators generally review whether their specific property type and rental arrangement meet the statutory definition before listing on a short term rental platform.

Ind. Code § 36-1-24-6 defines the types of residential arrangements that qualify as 'short term rentals' under Indiana law, which can affect what protections and rules apply to a stay of fewer than 30 days booked through a platform. Tenants or guests in single-family homes, multi-family units, condominiums, or even detached guest houses may find their arrangement covered by this chapter's framework. Those with questions about how this definition affects their rights in a short term rental situation may wish to consult a tenant-rights organization or legal aid resource familiar with Indiana housing law.
