Cal. Civ. Code § 36-1-24-19
Scope of this chapter
Operative Text
Sec. 19. This chapter does not affect, prohibit, preempt, or render unenforceable any property or use restrictions contained in properly enacted rules or regulations of a: (1) homeowners association; (2) condominium association; (3) lake owners association; or (4) similar property owners association or cooperative.
Indiana Code § 36-1-24-19 establishes a boundary on the reach of Chapter 24 by clarifying that nothing in the chapter overrides or invalidates property or use restrictions that have been properly adopted by homeowners associations, condominium associations, lake owners associations, or similar property owners associations and cooperatives. In other words, the chapter's rules operate alongside—rather than in place of—any valid association-level restrictions. Where a conflict might otherwise be imagined, this provision signals that association rules retain their independent force.
Plain English — not legal advice.
Property owners and managers operating within a homeowners association, condominium association, or similar cooperative structure should be aware that Ind. Code § 36-1-24-19 preserves the enforceability of any properly enacted association rules or restrictions. A compliant operator generally reviews both the statutory framework of Chapter 24 and the governing documents of any applicable association to understand the full set of obligations that apply to a given property. Keeping current with association rule changes is a standard part of managing properties subject to such governing bodies.

Under Ind. Code § 36-1-24-19, tenants living in properties governed by a homeowners association, condominium association, or similar body should understand that the association's properly enacted rules remain in effect independently of Chapter 24. This means that rights or protections under Chapter 24 do not automatically override restrictions an association has validly put in place. Tenants who believe an association rule conflicts with their rights may wish to review the association's governing documents, consult a tenant-rights organization, or seek guidance from a housing attorney familiar with Indiana law.
