Cal. Civ. Code § 32-31-9-13
Rights and obligations of other adult tenants
Operative Text
Sec. 13. Notwithstanding: (1) the termination of a protected individual's rights and obligations under a rental agreement under this chapter; or (2) the exclusion of a perpetrator of an applicable offense from a dwelling unit under this chapter; the rights and obligations of other adult tenants of the dwelling unit under the rental agreement continue unaffected. A landlord is not obligated to return or account for any security deposit associated with the rental agreement until forty-five (45) days after the tenancy of all tenants has terminated.
Indiana Code § 32-31-9-13 addresses what happens to a rental agreement when a protected individual's rights are terminated or a perpetrator is removed from a dwelling unit under Indiana's domestic-violence housing protections. The rule makes clear that these events do not alter the rights or obligations of any other adult tenants who remain on the lease. Additionally, a landlord is not required to return or account for a security deposit until 45 days after every tenant's occupancy has ended.

Under Ind. Code § 32-31-9-13, operators managing a unit where a protected individual's tenancy has been severed or a perpetrator has been excluded should continue treating the remaining adult tenants as fully bound by the original rental agreement. The lease terms, rent obligations, and other conditions remain in force for those tenants. Regarding the security deposit, compliant practice involves waiting until all tenants have vacated before the 45-day clock for returning or accounting for the deposit begins to run.

Ind. Code § 32-31-9-13 protects remaining adult tenants from losing their lease rights simply because another occupant's tenancy was terminated or a perpetrator was removed under Indiana's domestic-violence housing statutes. If you are a co-tenant in such a situation, your rights and obligations under the rental agreement continue as before. Regarding the security deposit, be aware that the landlord's 45-day obligation to return or account for it does not begin until all tenants have left the unit; tenant-rights organizations can help you understand how this timeline may apply to your circumstances.
