Cal. Civ. Code § 32-31-8.5-0.5
Waiver of chapter prohibited
Operative Text
Sec. 0.5. A waiver of this chapter by a landlord or tenant, including a former tenant, by contract or otherwise, is void.
Indiana Code § 32-31-8.5-0.5 establishes that the protections and obligations set out in Indiana Code Chapter 32-31-8.5 cannot be signed away or surrendered by either party to a rental agreement. Any contractual clause or other arrangement that purports to waive the chapter's provisions is legally void and without effect. This means the chapter's rules apply regardless of what a lease or other agreement may say to the contrary.
Plain English — not legal advice.
Under Ind. Code § 32-31-8.5-0.5, property owners and managers cannot include lease clauses that ask tenants to give up the rights or protections established by Chapter 32-31-8.5. Compliant operators review their lease agreements to ensure no language attempts to disclaim or waive the chapter's requirements. Even if such a clause were included, it would carry no legal weight and would not shield a landlord from the chapter's obligations.

Ind. Code § 32-31-8.5-0.5 means that even if a lease you signed contains language purporting to waive your rights under Chapter 32-31-8.5, that language is void and unenforceable. Tenants and former tenants alike retain the protections the chapter provides, regardless of what any contract says. If you believe a landlord is relying on a waiver clause to deny you those protections, tenant-rights organizations or legal aid services can help you understand the general options available under Indiana law.
