Cal. Civ. Code § 32-31-8-4
Effect of waiver of statute
Operative Text
Sec. 4. A waiver of the application of this chapter by a landlord or tenant, by contract or otherwise, is void.
Indiana Code § 32-31-8-4 establishes that neither a landlord nor a tenant can legally give up the protections and obligations set out in Indiana Code Chapter 32-31-8, regardless of whether they attempt to do so through a lease clause, a separate written agreement, or any other means. Any such waiver is automatically void and has no legal effect. The chapter's requirements remain in force even if both parties agreed in writing to set them aside.
Plain English — not legal advice.
Under Ind. Code § 32-31-8-4, property owners and managers cannot include lease provisions or side agreements that purport to waive either party's rights under Indiana Code Chapter 32-31-8. Compliant operators review their lease templates to ensure no clause attempts to disclaim or contract around the chapter's requirements. Because any such waiver is void by statute, including one does not reduce a landlord's obligations — it simply has no effect.

Ind. Code § 32-31-8-4 means that even if a lease you signed contains language waiving rights under Indiana Code Chapter 32-31-8, that language is legally void and cannot be enforced against you. Tenants who believe a landlord is relying on such a waiver clause to deny them protections may raise the statute as a defense in a legal proceeding or file a complaint with a relevant local or state housing authority. Consulting a tenant-rights organization familiar with Indiana landlord-tenant law can help clarify what protections under Chapter 32-31-8 remain available regardless of lease language.
