Cal. Civ. Code § 32-31-7-3
"Rental premises" defined
Operative Text
Sec. 3. As used in this chapter, "rental premises" includes all of the following: (1) A tenant's rental unit. (2) The structure in which the tenant's rental unit is a part.
Indiana Code § 32-31-7-3 establishes what the term "rental premises" means for the purposes of the chapter in which it appears. The definition is intentionally broad, covering not just the individual unit a tenant occupies but also the larger building or structure that contains that unit. This scope matters because rights, obligations, and protections described elsewhere in the chapter apply to both of these components together.
Plain English — not legal advice.
Under Ind. Code § 32-31-7-3, a landlord's responsibilities that reference "rental premises" extend beyond the walls of an individual apartment or unit. Compliant operators generally account for the condition and use of the entire building structure when evaluating their duties under this chapter, not just the interior of a specific rental unit. Keeping records and maintenance logs for both the unit and the broader structure can help demonstrate compliance with chapter-wide obligations.

Ind. Code § 32-31-7-3 means that tenant protections tied to the phrase "rental premises" in this chapter may cover conditions in the building as a whole, not only inside the rented unit itself. If a problem exists in a shared hallway, stairwell, or other part of the structure, that issue may still fall within the scope of this chapter's provisions. Tenants who believe their rights under this chapter have been affected by conditions in the broader building may wish to consult a local tenant-rights organization or legal aid office to understand what options are available.
