Cal. Civ. Code § 32-31-4-4
Lien on nonexempt property for expenses incurred by warehouseman or storage facility
Operative Text
Sec. 4. (a) A warehouseman or storage facility that receives property under this chapter holds a lien on all of that property that is not exempt property to the extent of the expenses for any of the following incurred by the warehouseman or storage facility with respect to all of the property, whether exempt or not exempt: (1) Storage. (2) Transportation. (3) Insurance. (4) Labor. (5) Present or future charges related to the property. (6) Expenses necessary for preservation of the property. (7) Expenses reasonably incurred in the lawful sale of the property. (b) A tenant may claim the tenant's property at any time until the sale of the property under section 5 of this chapter by paying the warehouseman or storage facility the expenses described in this section.
Indiana Code § 32-31-4-4 establishes that when a warehouseman or storage facility takes possession of a tenant's removed property under this chapter, it automatically acquires a lien on any non-exempt portion of that property. The lien covers a range of costs, including storage, transportation, insurance, labor, preservation, and reasonable sale expenses. A tenant retains the right to reclaim their property at any point before a sale occurs by paying the outstanding expenses covered by the lien.

Under Ind. Code § 32-31-4-4, landlords who arrange for a warehouseman or storage facility to receive a tenant's property should understand that the facility's lien attaches to non-exempt property for all qualifying expenses from the moment of receipt. Compliant operators typically keep clear, itemized records of all storage, transportation, insurance, labor, and preservation costs associated with the property. Maintaining accurate documentation helps ensure that any lien amount can be substantiated if a tenant seeks to reclaim their belongings before a sale.

Ind. Code § 32-31-4-4 gives tenants the right to reclaim their property at any time before it is sold by paying the expenses the warehouseman or storage facility has incurred, such as storage, transportation, and preservation costs. Tenants should be aware that only non-exempt property is subject to the lien, meaning certain property categories may be protected under Indiana law. Tenants who believe their property has been improperly liened or that exempt items are being held may wish to consult a tenant-rights organization or legal aid service for general information about their options.
