Plain English

Indiana Code § 32-31-4-1 defines a category of personal property called 'exempt property' within the context of landlord-tenant law. This definition covers items that are medically necessary for an individual, property used in a tenant's trade or business, and certain household essentials such as a week's worth of seasonably appropriate clothing, blankets, and items needed for a minor child's care and schooling. The designation of property as 'exempt' signals that such items receive special treatment under the broader chapter in which this definition appears.

For Property Managers

Under Ind. Code § 32-31-4-1, property owners and managers should be aware that certain categories of a tenant's personal property are classified as 'exempt property' and are afforded legal protections within this chapter. Compliant operators generally take care to identify and distinguish exempt items—such as medical equipment, trade tools, basic clothing, blankets, and children's educational materials—from non-exempt property when any action involving a tenant's belongings is contemplated. Familiarity with this definition helps operators avoid actions that could be challenged as improper interference with protected personal property.

For Tenants

Ind. Code § 32-31-4-1 establishes that certain personal belongings are classified as 'exempt property,' meaning they receive specific legal protections under Indiana landlord-tenant law. Items in this category include medically necessary equipment, tools or property used for your trade or business, a week's supply of appropriate seasonal clothing, blankets, and materials needed for a minor child's care or schooling. Tenants who believe their exempt property has been improperly handled may wish to consult a tenant-rights organization or legal aid provider to understand what remedies or defenses may be available under this chapter.
