Cal. Civ. Code § 32-31-11-5
Duty of courts to track eviction actions subject to nondisclosure order; furnishing of data to office of judicial administration for inclusion in reports
Operative Text
Sec. 5. (a) The clerk of court or other court administrator shall: (1) track all eviction actions with respect to which an order under section 3 or 4 of this chapter is issued by the court; and (2) furnish the data compiled under subdivision (1) in the statistical data provided to the office of judicial administration under IC 33-24-6-3(a)(2), at the time and in the form prescribed by the office. (b) The office of judicial administration shall include the data provided by courts under subsection (a)(2) in the office's reports under IC 33-24-6-3(a)(3).
Indiana Code § 32-31-11-5 establishes a data-tracking and reporting obligation tied to eviction cases that receive nondisclosure orders under this chapter. Court clerks and administrators must keep records of every eviction action covered by such an order and pass that compiled data along to the Office of Judicial Administration in the format and on the schedule that office requires. The Office of Judicial Administration, in turn, must incorporate that data into its own official statistical reports, creating a documented statewide picture of sealed or nondisclosed eviction proceedings.
Plain English — not legal advice.
Under Ind. Code § 32-31-11-5, the recordkeeping and reporting duties fall entirely on court personnel and the Office of Judicial Administration, not on landlords directly. However, property owners and managers who pursue eviction actions that result in nondisclosure orders should be aware that those cases are still tracked and counted in statewide judicial statistics, even if the case details are shielded from public view. Understanding that nondisclosed evictions remain part of an aggregate data set can inform how operators think about their overall compliance posture and documentation practices.

Ind. Code § 32-31-11-5 means that even when a court issues a nondisclosure order protecting a tenant's eviction record from public view, the case is not simply erased — it is counted and reported as part of statewide judicial data. Tenants who have obtained or are seeking a nondisclosure order under this chapter can take some assurance that the law requires courts to actively manage and report these cases, reflecting legislative attention to their prevalence. Tenants with questions about how nondisclosure orders affect their records may find it helpful to consult a tenant-rights organization or legal aid provider familiar with Indiana housing law.
