Cal. Civ. Code § 32-31-11-1
Applicability
Operative Text
Sec. 1. (a) This chapter applies to an eviction action that results in an outcome or occurrence described in section 3(a)(1) through 3(a)(3) and 3(b) of this chapter regardless of when the eviction action is originally filed. (b) This chapter does not apply to a hearing for damages in an eviction action in which a judgment has been awarded.
Indiana Code § 32-31-11-1 defines the scope of a chapter governing eviction actions in Indiana. Specifically, the chapter applies whenever an eviction action results in certain outcomes described elsewhere in the statute—namely those listed in sections 3(a)(1) through 3(a)(3) and 3(b)—regardless of when the case was originally filed. However, the chapter explicitly does not extend to hearings that address only monetary damages after a judgment has already been entered in an eviction case.

Under Ind. Code § 32-31-11-1, property owners and managers should be aware that the protections and requirements of this chapter can apply to eviction actions based on their outcome, not merely their filing date. Compliant operators generally familiarize themselves with the specific outcome categories defined in sections 3(a)(1)–3(a)(3) and 3(b) to understand when this chapter's rules are triggered. Notably, post-judgment damages hearings fall outside the chapter's scope, which affects how landlords may need to approach different phases of an eviction proceeding.

Ind. Code § 32-31-11-1 establishes that tenants involved in eviction actions may have the protections of this chapter available to them based on how the eviction case concludes, without regard to when it was filed. Tenants whose cases result in outcomes covered by sections 3(a)(1)–3(a)(3) and 3(b) may be able to raise this chapter's provisions as part of their case. Tenants seeking to understand whether these protections apply to their situation may benefit from consulting a local tenant-rights organization or legal aid office familiar with Indiana eviction law.
