Cal. Civ. Code § 32-31-1-21.1
Disclosure of property near a military installation
Operative Text
Sec. 21.1. (a) This section applies only to a lease entered into or renewed after June 30, 2023, for real property that is: (1) assessed as residential or commercial land under the real property assessment rules and guidelines of the department of local government finance; or (2) used for educational, literary, scientific, religious, or charitable purposes by a nonprofit corporation, organization, or association exempt from federal income taxation under Section 501 of the Internal Revenue Code. (b) The lessor shall disclose in the lease that: (1) the property is located near a military installation, within a state area of interest (as defined in IC 36-7-30.2-6), and may be impacted to some degree by the effects of the installation's military operations; and (2) local laws may restrict use and development of the property to promote compatibility with military installation operations.
Indiana Code § 32-31-1-21.1 requires that leases entered into or renewed after June 30, 2023, for certain residential, commercial, or nonprofit-use properties located near a military installation must include a written disclosure. The disclosure must inform the leaseholder that the property falls within a state area of interest, that military operations from the nearby installation may have some impact on the property, and that local laws could limit how the property is used or developed. This rule applies to both private landlords and nonprofit lessors whose properties meet the geographic and classification criteria.
Plain English — not legal advice.
Under Ind. Code § 32-31-1-21.1, property owners and managers whose properties are located near a military installation and fall within a designated state area of interest are generally expected to include the required disclosure language directly within the body of any lease entered into or renewed after June 30, 2023. Compliant operators typically verify whether their property is classified as residential or commercial under local assessment rules, or qualifies under the nonprofit-use category, before executing new or renewed leases. Keeping documentation of the property's classification and proximity to a military installation can support consistent compliance across a portfolio.

Ind. Code § 32-31-1-21.1 gives tenants the right to receive written notice within their lease that a property is near a military installation and within a state area of interest, along with notice that local development restrictions may apply. If a lease entered into or renewed after June 30, 2023 does not include this disclosure, a tenant may have grounds to raise the omission as a concern, including as a potential defense or issue in a legal proceeding. Tenants who believe this disclosure was not provided can seek information from a local tenant-rights organization or consult with a licensed Indiana attorney to understand what options may be available.
