Under Indiana Code § 32-30-8-13, when a court handles a nuisance action involving a rental or other property, it has the authority to require the property owner to develop and submit a formal correction plan for the court's review and approval. This plan is intended to reduce the likelihood that the property will be used for a nuisance again, to the extent that is reasonably achievable. The court may impose this requirement only when the owner was both a named party in the legal action and had prior knowledge of the nuisance.

For Property Managers

Indiana Code § 32-30-8-13 means that property owners who are named defendants in a nuisance action and who had knowledge of the nuisance may be directed by the court to produce a written correction plan outlining steps to prevent future nuisance activity on the property. Operators who proactively document their awareness of and responses to problem activity on their properties generally demonstrate good-faith compliance efforts. Maintaining thorough records of tenant communications, lease enforcement actions, and any remediation measures taken can be relevant to how a court evaluates an owner's conduct under this provision.

For Tenants

Indiana Code § 32-30-8-13 gives courts the power to require a property owner to submit a court-approved plan aimed at preventing future nuisance conditions at a property, which can be a meaningful tool for addressing ongoing or recurring problems. If a nuisance action is brought under this chapter and the owner was aware of the nuisance, tenants or community members affected by the nuisance may benefit from the court's oversight of the owner's corrective steps. Those concerned about nuisance conditions at a property may wish to consult a tenant-rights organization or legal aid provider to understand how proceedings under this chapter could apply to their situation.
