Plain English

Under Indiana Code § 32-30-8-11, a court has the authority to order a tenant to leave a rental property within 72 hours if, after holding a hearing, the court finds that the tenant created a nuisance on the leased premises. This order can be issued on its own or alongside other remedies available under the chapter. The provision operates independently of other laws that might otherwise affect the timeline or process for removing a tenant.

For Property Managers

Indiana Code § 32-30-8-11 provides property owners with a court-based mechanism to seek rapid removal of a tenant found to have created a nuisance. A compliant operator typically documents nuisance conditions thoroughly, pursues the appropriate court hearing under this chapter, and understands that a vacate order—if granted—requires the tenant to leave within 72 hours of issuance. This remedy may be pursued alongside or as part of other remedies available under the broader statutory framework.

For Tenants

Under Ind. Code § 32-30-8-11, a court may only issue a 72-hour vacate order after conducting a hearing, meaning a tenant has an opportunity to appear and present their side before any such order is entered. Tenants who receive notice of a nuisance-related hearing may wish to gather documentation relevant to the allegations and explore available defenses. Local tenant-rights organizations or legal aid services can help tenants understand what options may be available when facing proceedings under this provision.
