Cal. Civ. Code § 24-5-0.5-0.1
Application of certain amendments to chapter
Operative Text
Sec. 0.1. The following amendments to this chapter apply as follows: (1) The amendments made to sections 2, 3, and 4 of this chapter by P.L.24-1989 are clarifications only and should not be construed as modifications of existing law. (2) The amendments made to sections 2 and 3 of this chapter by P.L.174-1997 apply to local telephone directories published after May 31, 1997.
Indiana Code § 24-5-0.5-0.1 establishes how two sets of legislative amendments to Indiana's consumer protection chapter are to be interpreted and applied. The 1989 amendments (P.L.24-1989) to sections 2, 3, and 4 are designated as clarifications of pre-existing law rather than changes to it, meaning they do not alter the legal landscape retroactively. The 1997 amendments (P.L.174-1997) to sections 2 and 3 have a specific effective date, applying only to local telephone directories published after May 31, 1997.

Property owners and managers operating in Indiana should be aware that Ind. Code § 24-5-0.5-0.1 governs how certain amendments to the state's consumer protection chapter are interpreted. Because the 1989 amendments are deemed clarifications rather than new law, compliant operators generally treat the underlying rules in sections 2, 3, and 4 as having been consistently in effect. The 1997 amendments' applicability tied to a specific publication date means that business practices involving local telephone directories from before June 1, 1997, are evaluated under the prior framework.

Ind. Code § 24-5-0.5-0.1 is relevant to tenants and consumers who may be evaluating claims or disputes arising under Indiana's consumer protection chapter. Because the 1989 amendments are characterized as clarifications, they do not create new rights or obligations — they reflect what the law was already understood to mean. Tenants or consumers with concerns about how these provisions apply to a particular situation may wish to consult a tenant-rights organization or legal aid service familiar with Indiana consumer protection law.
