Cal. Civ. Code § 22-9.5-6-17
Discriminatory practice in course of business subject to licensing or regulation by governmental agency; copies of findings and order to agency; recommendation of discipline
Operative Text
Sec. 17. If the commission issues an order with respect to a discriminatory housing practice that occurred in the course of a business subject to licensing or regulation by a governmental agency, the commission shall, not later than thirty (30) days after the date of the issuance of the order: (1) send copies of the findings and the order to the governmental agency; and (2) recommend to the governmental agency appropriate disciplinary action.
Indiana Code § 22-9.5-6-17 establishes a coordination mechanism between the civil rights commission and other government licensing bodies. When the commission issues an order finding that a discriminatory housing practice took place within a licensed or regulated business, it must notify the relevant licensing agency and recommend disciplinary action—all within thirty days of issuing the order. This provision ensures that professional licenses or regulatory standing can be affected by findings of housing discrimination, extending accountability beyond the commission's own enforcement process.

Property owners and managers who operate under a professional license or within a regulated industry—such as real estate brokers, property management firms, or mortgage lenders—should be aware that under Ind. Code § 22-9.5-6-17, a commission order finding discriminatory housing practices triggers mandatory referral to the relevant licensing authority. Compliant operators generally maintain fair housing policies, train staff on anti-discrimination requirements, and document their practices to avoid findings that could reach their licensing body. A commission order under this section can set in motion a separate disciplinary process with the agency that issued the operator's license or oversees their industry.

Ind. Code § 22-9.5-6-17 provides tenants with an additional layer of accountability when a housing discrimination complaint involves a licensed professional or regulated business. If the commission issues an order in a tenant's favor, the law requires that the findings be forwarded to the relevant licensing agency along with a recommendation for disciplinary action—potentially affecting the respondent's ability to continue operating. Tenants who believe they have experienced housing discrimination by a licensed professional may explore filing a complaint with the commission, and tenant-rights organizations can help explain how this referral process works alongside other available remedies.
