Plain English

Indiana Code § 16-41-27-16.6 addresses weather radio and smoke detector battery maintenance in mobile home communities. Each year during National Fire Prevention Week, community operators are encouraged—though not required—to send residents a written reminder to replace batteries in their weather radios and smoke detectors. The provision also establishes that any reminders, assistance, or instructions an operator voluntarily provides about these devices do not create legal liability for the operator, owner, or employees regarding whether those devices actually function.

For Property Managers

Under Ind. Code § 16-41-27-16.6, operators of mobile home communities are encouraged to issue annual written battery-replacement reminders to residents during National Fire Prevention Week, though the statute frames this as a recommendation rather than a mandate. Operators who choose to go further—offering assistance or instructions about weather radios or smoke detectors—are expressly shielded from liability for the functionality of those devices. Compliant operators typically document any outreach they conduct so there is a clear record of voluntary safety communications.

For Tenants

Ind. Code § 16-41-27-16.6 reflects a state policy encouraging mobile home community operators to remind residents annually to replace batteries in smoke detectors and weather radios, particularly during National Fire Prevention Week. While this reminder is not a legal requirement imposed on operators, residents can use this provision as context when discussing safety maintenance expectations with their community management. Tenants who have concerns about safety device requirements in their community may wish to consult a tenant-rights organization or review any applicable lease terms and local ordinances for additional protections.
