Operative Text
Sec. 1. (a) This rule contains the procedures established by the ICRC for the investigation and conciliation of a complaint under IC 22-9.5-6. (b) This rule applies to the following: (1) A complaint alleging discriminatory housing practices because of race, color, religion, sex, or national origin. (2) A complaint alleging discriminatory housing practices because of handicap or familial status occurring on or after July 1, 1992. (c) 910 IAC 2-7 governs the administrative proceedings before an administrative law judge adjudicating charges issued under section 6(b) of this rule.
Section 910 IAC 2 § 910-2-6-1 establishes the scope and purpose of the Indiana Civil Rights Commission's (ICRC) complaint investigation and conciliation procedures under IC 22-9.5-6. The rule covers housing discrimination complaints based on race, color, religion, sex, or national origin, as well as complaints related to handicap or familial status that arose on or after July 1, 1992. When a charge is issued under this rule, formal administrative proceedings before an administrative law judge are governed by the separate provisions found in 910 IAC 2-7.
Plain English — not legal advice.
Under 910 IAC 2 § 910-2-6-1, property owners and managers should be aware that the ICRC has established formal procedures for investigating and attempting to conciliate housing discrimination complaints across several protected categories, including race, color, religion, sex, national origin, handicap, and familial status. Operators who receive notice of a complaint filed under IC 22-9.5-6 can expect to engage with the ICRC's investigation and conciliation process as outlined in this rule. If conciliation is unsuccessful and a charge is issued, the matter may proceed to an administrative law judge under 910 IAC 2-7.

Section 910 IAC 2 § 910-2-6-1 outlines the ICRC's process for handling complaints from individuals who believe they have experienced housing discrimination based on protected characteristics such as race, color, religion, sex, national origin, handicap, or familial status. Tenants or prospective tenants who believe they have experienced such discrimination may file a complaint under IC 22-9.5-6, which triggers the ICRC's investigation and conciliation procedures described in this rule. If the process advances to a formal charge, 910 IAC 2-7 governs the administrative hearing stage, and tenant-rights organizations can help individuals understand what each stage of this process generally involves.
