(5) Evicting tenants because of their race, color, religion, sex, handicap, familial status, or national origin or because of the race, color, religion, sex, handicap, familial status, or national origin of a tenant's guest.
Section 910-2-2-2 of 910 IAC 2 prohibits any person from refusing to sell or rent a dwelling, declining to negotiate, or otherwise discriminating in housing transactions on the basis of race, color, religion, sex, familial status, national origin, or handicap. The rule covers a broad range of conduct, including applying different pricing, qualification criteria, application fees, or approval procedures based on these protected characteristics. It also extends protections to tenants facing eviction motivated by the protected characteristics of themselves or even their guests.

Under 910 IAC 2 § 910-2-2-2, compliant property owners and managers apply uniform criteria — such as consistent income standards, application fees, credit review processes, and rental charges — to all prospective and current tenants regardless of race, color, religion, sex, handicap, familial status, or national origin. Operators generally document their qualification standards in writing and apply them evenhandedly so that no applicant or tenant is treated differently based on a protected characteristic. Eviction decisions are likewise grounded in lease terms and conduct, not in the protected characteristics of a tenant or their guests.

910 IAC 2 § 910-2-2-2 gives renters and prospective buyers the right to be evaluated on neutral, consistently applied criteria and to be free from refusals, pricing disparities, or evictions driven by race, color, religion, sex, handicap, familial status, or national origin. Tenants who believe they have experienced such discrimination may consider filing a complaint with the Indiana Civil Rights Commission or with the U.S. Department of Housing and Urban Development, which administers overlapping federal fair housing protections. Tenant-rights organizations and legal aid offices can help individuals understand what documentation may be relevant and what complaint processes are available.
