Cal. Civ. Code § 910-2-2-11
Discrimination in making a loan and providing other financial assistance
Operative Text
Sec. 11. (a) It shall be unlawful for any person or entity whose business includes engaging in a residential real estate related transaction to discriminate against any person in making available a loan or other financial assistance for a dwelling, or a loan or other financial assistance which is to be secured by dwelling, because of race, color, religion, sex, handicap, familial status, or national origin. (b) Prohibited practices under this section include, but are not limited to, the following: (1) Failing or refusing to provide to any person in connection with a residential real estate related transaction information regarding the availability of loans or other financial assistance, application requirements, procedures, or standards for the review and approval of loans or financial assistance. (2) Providing information which is inaccurate or different from that provided others because of race, color, religion, sex, handicap, familial status, or national origin.
Section 910-2-2-11 of 910 IAC 2 prohibits any business involved in residential real estate lending from discriminating on the basis of race, color, religion, sex, handicap, familial status, or national origin when making loans or other financial assistance available for dwellings. The rule covers both the decision to provide financing and the information shared during the process, meaning lenders cannot withhold, distort, or selectively disclose loan terms or application requirements based on these protected characteristics. This provision applies broadly to any residential real estate-related transaction where a dwelling serves as collateral or the purpose of the financing.

Property owners and managers who are involved in arranging or facilitating residential financing should be aware that 910 IAC 2 § 910-2-2-11 imposes obligations on lenders and financial institutions operating in Indiana's residential real estate market. Compliant operators in this space ensure that all applicants receive the same accurate information about loan availability, application requirements, and approval standards, regardless of their race, color, religion, sex, handicap, familial status, or national origin. Maintaining consistent, documented communication practices across all applicants is a hallmark of operations that align with this provision.

Under 910 IAC 2 § 910-2-2-11, Indiana residents seeking residential financing have the right to receive accurate and consistent information about loan availability, application procedures, and approval standards without regard to their race, color, religion, sex, handicap, familial status, or national origin. If a borrower believes they were denied information, given inaccurate terms, or treated differently than other applicants based on a protected characteristic, that experience may constitute a violation of this provision. Potential enforcement paths include filing a fair housing complaint with a relevant state or federal agency, or consulting a tenant-rights or fair housing organization for guidance on available options.
