Cal. Civ. Code § 910-2-1-1
Scope
Operative Text
Sec. 1. (a) It is the policy of the ICRC to provide for fair housing throughout the state of Indiana. No person shall be subjected to discrimination because of race, color, religion, sex, handicap, familial status, or national origin in the sale, rental, or advertising of a dwelling, in the provision of brokerage services, or in the availability of a residential real estate related transaction. (b) This article provides the ICRC's interpretation of the coverage and application of IC 22-9.5 regarding discrimination related to the sale or rental of a dwelling, the provision of services in connection therewith, and the availability of a residential real estate related transaction.
Section 910-2-1-1 of 910 IAC 2 establishes Indiana's statewide fair housing policy as administered by the Indiana Civil Rights Commission (ICRC). It prohibits discrimination based on race, color, religion, sex, handicap, familial status, or national origin across a broad range of housing-related activities, including selling, renting, advertising dwellings, providing brokerage services, and offering residential real estate transactions. This provision also signals that the article as a whole reflects the ICRC's interpretation of how Indiana Code 22-9.5 applies to these activities.
Plain English — not legal advice.
Under 910 IAC 2 § 910-2-1-1, property owners and managers operating in Indiana are expected to conduct all aspects of their housing business — including listings, advertising, tenant screening, and transaction services — without regard to a prospective or current resident's race, color, religion, sex, handicap, familial status, or national origin. Compliant operators typically review their advertising language, application processes, and service offerings to ensure none of these protected characteristics factor into housing decisions. Because this provision reflects the ICRC's interpretation of IC 22-9.5, operators generally stay informed of ICRC guidance when assessing their practices.

910 IAC 2 § 910-2-1-1 affirms that Indiana residents are protected from housing discrimination on the basis of race, color, religion, sex, handicap, familial status, or national origin throughout the state. This protection extends to the full range of housing activities — from rental and sale transactions to advertising and brokerage services — under the oversight of the Indiana Civil Rights Commission (ICRC). Individuals who believe they have experienced a violation of this provision may consider filing a complaint with the ICRC, raising the issue with a tenant-rights organization, or consulting an attorney familiar with Indiana fair housing law.
