Plain English

Under 410 IAC 38 § 410-38-4-5, only individuals who appear on the Indiana Department of Health's qualified inspector list are authorized to supervise or inspect contaminated property decontamination, issue certificates of decontamination, or advertise such services. Any certificate of decontamination issued by someone not on that list is legally invalid and cannot be used to certify that a property has been properly decontaminated. This rule establishes a credentialing threshold intended to ensure that decontamination work—typically related to properties formerly used for methamphetamine production—is overseen by vetted professionals.

For Property Managers

Property owners and managers dealing with a contaminated property under 410 IAC 38 § 410-38-4-5 generally verify that any inspector or decontamination supervisor they engage appears on the Indiana Department of Health's qualified inspector list before work begins. Compliant operators retain documentation confirming the inspector's listed status, since a certificate issued by an unlisted individual carries no legal validity and would not satisfy regulatory requirements. Keeping records of the inspector's credentials helps demonstrate that the decontamination process met the standards set by this provision.

For Tenants

Under 410 IAC 38 § 410-38-4-5, tenants have an interest in knowing whether a certificate of decontamination presented for a rental property was issued by someone on the Indiana Department of Health's qualified inspector list, because certificates from unlisted individuals are explicitly invalid. If a landlord relies on such a certificate to claim a property is safe for occupancy, tenants may raise the certificate's invalidity as a concern when engaging with local health authorities or a tenant-rights organization. Reviewing the qualified inspector list directly through the Indiana Department of Health is one way to verify whether the person who issued a certificate was properly authorized under this provision.
