Under 410 IAC 38 § 410-38-4-2, Indiana establishes the qualifications a person must hold to be listed as a qualified inspector of contaminated properties. Eligibility requires a combination of hands-on hazardous-materials experience, federally mandated supervisor training, department-specific instruction and examination, and substantial insurance coverage. Inspectors must also complete ongoing refresher training — both annually and every two years — to remain on the qualified inspector list.

For property owners dealing with a contaminated property under 410 IAC 38 § 410-38-4-2, working with an inspector who appears on Indiana's qualified inspector list is a key part of the decontamination process. Compliant operators generally verify that any inspector they engage holds the required experience hours, has passed the department's examination, and carries the minimum professional liability, errors and omissions, and pollution prevention insurance amounts specified in the rule. Retaining documentation of an inspector's credentials and insurance certificates is a standard practice in managing contaminated-property compliance.

If you live in or near a property subject to contamination concerns in Indiana, 410 IAC 38 § 410-38-4-2 sets the standards that any inspector assessing that property must meet, including verified training, examination scores, and significant insurance coverage. Tenants have a general interest in confirming that inspections are conducted by someone on the state's qualified inspector list, as the rule is designed to ensure inspections are performed by credentialed professionals. Tenant-rights organizations and the Indiana State Department of Health can be resources for understanding how the qualified inspector framework applies to a particular property situation.
