Cal. Civ. Code § 410-38-2-10
"Decontaminate" or "decontamination" defined
Operative Text
Sec. 10. "Decontaminate" or "decontamination" means removal of chemicals used in the illegal manufacture of a controlled substance from a contaminated property that occurs after the operation used for illegal manufacture of a controlled substance has been dismantled by a law enforcement agency or its agents. Decontamination may include either or both of the following: (1) Reduction of the level of the controlled substance to or below the final decontamination levels listed in 410 IAC 38-5-2, Table 1. (2) Removal of all potentially contaminated materials under 410 IAC 38-5-4.
Section 410 IAC 38-2-10 establishes the official meaning of 'decontaminate' and 'decontamination' within Indiana's regulatory framework for properties formerly used in illegal drug manufacturing. The term covers the removal of chemicals left behind by illegal controlled-substance production, but only after law enforcement has already dismantled the operation. Decontamination can be satisfied by reducing chemical levels to the thresholds set in 410 IAC 38-5-2, Table 1, by removing all potentially contaminated materials under 410 IAC 38-5-4, or by doing both.
Plain English — not legal advice.
Property owners and managers dealing with a former illegal drug-manufacturing site should understand that, under 410 IAC 38-2-10, the decontamination process cannot begin until law enforcement has officially dismantled the operation. Compliant operators typically document that the site meets either the chemical-level thresholds in 410 IAC 38-5-2, Table 1, or the material-removal standards in 410 IAC 38-5-4, or both. Maintaining clear records of the remediation steps taken and the sequence in which they occurred is a common practice for demonstrating compliance with Indiana's contaminated-property rules.

If you are considering renting or currently occupy a property with a history of illegal drug manufacturing, 410 IAC 38-2-10 defines the baseline standard that must be met before a property is considered decontaminated under Indiana law. Tenants have a general interest in confirming that any required decontamination—meeting the chemical-level standards of 410 IAC 38-5-2, Table 1, or the material-removal standards of 410 IAC 38-5-4—was properly completed after law enforcement dismantled the operation. Tenant-rights organizations and local health departments can be resources for understanding what documentation of completed decontamination should look like.
