Cal. Civ. Code § 170-15-1-0.5
Scope
Operative Text
Sec. 0.5. (a) A landlord and an association may only sub-bill water or sewage disposal service under this article. (b) Under IC 8-1-2-1.2(k), a landlord or an association that sub-bills is not a public utility if the landlord or association complies with: (1) IC 8-1-2-1.2(k)(1); or (2) IC 8-1-2-1.2(k)(2), IC 8-1-2-1.2(l), and IC 8-1-2-1.2(m). (c) This article does not apply to the following: (1) A landlord or an association that distributes water or sewage disposal service using a flat fee qualifying under IC 8-1-2- 1.2(k)(1). (2) A landlord that bills a tenant for water or sewage disposal service if: (A) the tenant resides in a building with only one (1) dwelling unit; and (B) the dwelling unit is metered by the water or sewer utility.
Indiana Administrative Code 170 IAC 15 § 170-15-1-0.5 defines the boundaries of a specific sub-billing framework for water and sewage disposal services. Under this provision, only water and sewage disposal—not other utilities—may be sub-billed by landlords or associations under this article's rules. Certain arrangements fall entirely outside the article's reach: landlords using a qualifying flat-fee structure, and landlords billing a single-unit building where that unit is directly metered by the utility, are not subject to these regulations at all.
Plain English — not legal advice.
Under 170 IAC 15 § 170-15-1-0.5, operators who sub-bill tenants for water or sewage disposal must ensure their billing practices fall within the scope of this article to avoid being classified as a public utility. Compliant operators generally confirm whether their arrangement qualifies under the relevant Indiana Code provisions—IC 8-1-2-1.2(k)(1) or the combination of IC 8-1-2-1.2(k)(2), (l), and (m)—before sub-billing. Operators using a flat-fee structure that qualifies under IC 8-1-2-1.2(k)(1), or those billing a single directly-metered dwelling unit, should be aware that this article's requirements do not apply to those specific arrangements.

Section 170-15-1-0.5 of 170 IAC 15 establishes which water and sewage sub-billing situations are governed by Indiana's sub-billing rules and which are exempt. Tenants living in a single-unit building that is directly metered by the water or sewer utility are outside the scope of this article, meaning their landlord's billing practices fall under different legal frameworks. Tenants who believe their landlord's sub-billing arrangement may not comply with the applicable Indiana Code provisions can explore their options by contacting a tenant-rights organization or reviewing the Indiana Utility Regulatory Commission's resources.
