Under 765 Ill. Comp. Stat. 745 § 6.6, when a mobile home park owner becomes involved in a bankruptcy case or a foreclosure proceeding is initiated against the park property, tenants must be formally notified in writing within 30 days. The notice obligation applies whether the bankruptcy is filed voluntarily by the owner or involuntarily against them, and a separately appointed receiver must also notify tenants of their appointment. Acceptable delivery methods include personal delivery, leaving the notice with a resident aged 13 or older at the premises, or sending it by first-class mail to the tenant's known name and address.

Park owners and operators subject to 765 Ill. Comp. Stat. 745 § 6.6 generally maintain systems to track the 30-day notice deadline from the moment a bankruptcy petition is filed or legal process is served in connection with a foreclosure. Compliant operators document their chosen delivery method — personal delivery, leaving notice with a qualifying resident, or first-class mail — and retain proof of that service. When a receiver is appointed, coordinating with the receiver to ensure tenant notification under Section 15-1704(f) of the Code of Civil Procedure is also part of a complete compliance posture.

Under 765 Ill. Comp. Stat. 745 § 6.6, mobile home park tenants in Illinois have a right to written notice within 30 days if their park owner files for bankruptcy or a foreclosure proceeding is started against the park property. Tenants who believe they did not receive required notice may wish to consult a tenant-rights organization, a legal aid provider, or review the Illinois Mobile Home Landlord and Tenant Rights Act to understand what remedies or defenses may be available.
