Section 745 § 6.30 of the Illinois Compiled Statutes establishes that a manufactured home park homeowners' association must be governed by its bylaws, and that certain provisions are automatically deemed included in those bylaws even if not explicitly written. The rule specifies a default governance structure: a five-member board of directors that elects a president, secretary, and treasurer, all of whom serve without pay and at the board's discretion. Any additional administrative and governance requirements are governed by the Illinois Common Interest Community Association Act.

For Property Managers

As a park owner or operator subject to 765 Ill. Comp. Stat. 745 § 6.30, compliant operators ensure that the association's bylaws clearly describe the form of administration, officer titles, board composition, and the powers and duties of each role. Where bylaws are silent on these matters, the statute's default provisions—including a five-member board and unpaid officers—automatically apply, so operators generally review their governing documents to confirm alignment with the statute. Additional governance obligations are cross-referenced in the Common Interest Community Association Act, which compliant operators also consult when structuring association administration.

For Tenants

Residents of a manufactured home park covered by 765 Ill. Comp. Stat. 745 § 6.30 have a right to an association governed by bylaws that meet the statute's minimum requirements, including a defined board structure and officer roles. If an association appears to be operating without proper bylaws or outside the governance framework the statute requires, residents can request to review the association's governing documents, which they are generally entitled to inspect. Tenant-rights organizations, legal aid services, or the Illinois Attorney General's office can be consulted to understand available options when an association's governance does not appear to comply with this provision.
