Homeowners' associations. Upon incorporation of the association, all consenting mobile home owners in the park may become members or shareholders. "Member" or "shareholder" means a mobile homeowner who consents to be bound by the articles of incorporation, bylaws, and policies of the incorporated homeowners' association. The association may not have a member or shareholder who is not a bona fide owner of a mobile home located in the park. Upon incorporation and service of the notice described in Section 6.28, the association shall become the representative of all the mobile home owners in all matters relating to this Act, regardless of whether the homeowner is a member of the association.
Under 765 Ill. Comp. Stat. 745 § 6.27, mobile home park residents who wish to exercise collective rights under the Illinois Mobile Home Landlord and Tenant Act must first form a legally incorporated homeowners' association. At least two-thirds of all mobile home owners in the park must provide written consent to join before the association can be established. Once incorporated and after proper notice is served as described in Section 6.28, the association automatically becomes the representative of every mobile home owner in the park on matters covered by the Act, even those who never joined the association.

Park operators and managers should be aware that under 765 Ill. Comp. Stat. 745 § 6.27, a properly formed and incorporated homeowners' association — one that has met the two-thirds written-consent threshold — legally represents all mobile home owners in the park for purposes of the Act. Compliant park management typically recognizes the association as the collective bargaining representative once incorporation and the Section 6.28 notice requirements are satisfied. Keeping records of any notice served by such an association and understanding its representative scope helps operators respond appropriately to association communications.

Section 6.27 of 765 Ill. Comp. Stat. 745 establishes the framework through which mobile home park residents can organize a homeowners' association to collectively exercise rights under the Act. Residents interested in forming such an association generally work to secure written consent from at least two-thirds of all mobile home owners in the park and pursue formal incorporation as a corporation or not-for-profit. Once those steps and the notice requirement of Section 6.28 are completed, the association represents all owners in the park under the Act — tenant-rights organizations familiar with Illinois mobile home law can provide general information about how this process works.
