Idaho Code § 6-201 § 6-201
ACTIONS FOR WASTE.
Operative Text
If a guardian, tenant for life or years, joint tenant or tenant in common of real property, commit waste thereon, any person aggrieved by the waste may bring an action against him therefor, in which action there may be judgment for treble damages.
Idaho Code § 6-201 addresses the legal concept of 'waste,' which refers to actions by certain property occupants—such as life tenants, tenants for a term of years, joint tenants, or tenants in common—that damage or diminish the value of real property. Under this provision, any person harmed by such waste has the right to bring a civil lawsuit. If the court finds that waste occurred, it may award the injured party up to three times the actual damages suffered.
Plain English — not legal advice.
Under Idaho Code § 6-201, property owners and co-owners who believe a tenant or co-tenant is committing waste—meaning conduct that damages or devalues the real property—have a civil remedy available to them. Compliant property managers generally document the condition of their property regularly and address deterioration or misuse promptly. Because this statute allows for treble damages, maintaining clear records of property condition can be important when pursuing or defending against a waste claim.

Idaho Code § 6-201 establishes that tenants for life or for a term of years, as well as joint tenants and tenants in common, can be held legally responsible for waste committed on real property. Tenants who receive a claim of waste may wish to understand what conduct legally qualifies as waste under Idaho law, as the statute allows courts to award up to three times the actual damages. Consulting a tenant-rights organization or a licensed Idaho attorney can help a tenant understand what defenses or responses may be available in a waste action.
