Idaho Code §§ 67-5901, 5902, 5907 to 5911 § 67-5901
PURPOSE OF CHAPTER.
Operative Text
The general purposes of this chapter are: (1) To provide for execution within the state of the policies embodied in the federal Civil Rights Act of 1964, as amended, and the Age Discrimination in Employment Act of 1967, as amended, and Titles I and III of the Americans with Disabilities Act. (2) To secure for all individuals within the state freedom from discrimination because of race, color, religion, sex or national origin or disability in connection with employment, public accommodations, and real property transactions, discrimination because of race, color, religion, sex or national origin in connection with education, discrimination because of age in connection with employment, and thereby to protect their interest in personal dignity, to make available to the state their full productive capacities, to secure the state against domestic strife and unrest, to preserve the public safety, health, and general welfare, and to promote the interests, rights and privileges of individuals within the state.
Section 67-5901 of the Idaho Human Rights Act sets out the overarching goals of the chapter, which are to align Idaho state policy with federal civil rights protections and to prohibit discrimination based on race, color, religion, sex, national origin, disability, or age across employment, public accommodations, real property transactions, and education. The provision frames these protections as serving broad public interests, including personal dignity, public safety, and general welfare. It draws its authority from federal frameworks including the Civil Rights Act of 1964, the Age Discrimination in Employment Act of 1967, and the Americans with Disabilities Act.
Plain English — not legal advice.
Under § 67-5901, Idaho's Human Rights Act establishes that real property transactions are an explicit area where discrimination protections apply, meaning property owners and managers operating in Idaho are expected to conduct rental and sales activities free from discrimination based on race, color, religion, sex, national origin, and disability. Compliant operators generally maintain consistent, non-discriminatory criteria for tenant screening, advertising, and lease terms. Familiarity with both the state chapter and the federal laws it references helps property managers understand the full scope of obligations that apply to their operations.

Section 67-5901 of the Idaho Human Rights Act affirms that individuals in Idaho have a right to be free from discrimination in real property transactions on the basis of race, color, religion, sex, national origin, or disability. If a tenant believes a landlord's actions in renting or managing housing have violated these protections, general enforcement paths can include filing a complaint with the Idaho Human Rights Commission, which administers this chapter, or exploring federal complaint processes through agencies such as the U.S. Department of Housing and Urban Development. Tenant-rights organizations can help individuals understand which avenue may be appropriate for their circumstances.
