Plain English

Under Idaho Code Title 55 ch. 20 § 55-2008, a manufactured home community rule is only binding on a resident if it was part of the rental agreement the resident signed, or if the resident later consented to it or received at least 90 days' written notice before it took effect. Rules adopted after move-in that restrict the type or size of homes permitted in the community cannot be applied to residents whose homes were already in compliance when the rule was adopted or amended. All community rules must include an effective date and must be enforced fairly and uniformly across residents.

For Property Managers

Under § 55-2008, compliant community operators ensure that all rules intended to bind residents are incorporated into the signed rental agreement at the time of move-in. When a rule is adopted or amended after a resident has already signed their agreement, operators generally provide at least 90 days' written notice before enforcement begins, unless the resident affirmatively consents to the change sooner. Operators also take care that any new restrictions on home type or size are not applied to residents whose homes were already in compliance, and that all rules carry a clear effective date and are applied consistently across the community.

For Tenants

Section 55-2008 of the Idaho Manufactured Home Residency Act gives residents the right to challenge any community rule that was not part of their original signed rental agreement and for which they did not receive at least 90 days' written notice. Residents whose homes were in compliance with community rules before a new size or type restriction was adopted generally cannot have that restriction enforced against them. Tenants who believe a rule is being applied retroactively, inconsistently, or without proper notice may consider raising the violation as a defense in any enforcement proceeding, filing a complaint with a relevant Idaho state agency, or reaching out to a tenant-rights organization for general information about available options.
