Operative Text
Any individual who petitions for a declaratory ruling on the applicability of a statute or rule administered by the Commission must substantially comply with this rule. The petition addressed to the Administrator will: (3-31-22) 01. Identify. Identify the petitioner and state the petitioner’s interest in the matter; (3-31-22) 02. State. State the declaratory ruling that the petitioner seeks; and (3-31-22) 03. Cite. Cite the statute, rule, or other controlling law and the factual allegations upon which the petitioner relies to support the petition. (3-31-22)
IDAPA 45.01.01 § 004 establishes the procedural requirements for petitioning Idaho's Commission for a declaratory ruling on how a statute or rule applies. A valid petition must identify who is filing and why they have an interest, specify the ruling being sought, and cite the relevant legal authority along with the supporting facts. Substantial compliance with these requirements is the standard the Commission uses to evaluate whether a petition is properly before it.

Under IDAPA 45.01.01 § 004, property owners or managers who want formal guidance on how a Commission-administered statute or rule applies to their operations may seek a declaratory ruling by submitting a petition to the Administrator. A compliant petition clearly identifies the operator, describes their interest in the matter, states the specific ruling sought, and references the applicable statutes or rules alongside the relevant facts. Operators generally keep records of the factual circumstances they rely on when preparing such a petition to ensure the submission meets the substantial-compliance standard.

IDAPA 45.01.01 § 004 provides a formal avenue for individuals, including tenants, to ask the Commission for an official interpretation of how a particular statute or rule applies to their situation. A petition must identify the filer and their interest, describe the ruling being requested, and cite the controlling law and facts being relied upon. Tenants who believe a Commission-administered rule affects their housing circumstances may consult a tenant-rights organization to better understand whether this petition process is an appropriate path for obtaining clarity.
