Fla. Stat. § 723.001 et seq. § 723.073
Conveyance by the association.
Operative Text
(1) In the event that an association acquires a mobile home park and intends to reconvey a portion or portions of the property acquired to members of the association, the association shall record copies of its articles and bylaws and any additional covenants, restrictions, or declarations of servitude affecting the property with the clerk of the circuit court prior to the conveyance of any portion of the property to an individual member of the association. To create a mobile home cooperative after acquisition of the property, the association shall record the cooperative documents, as required by chapter 719, in the county where the property is located. The effective date of the cooperative shall be the date of the recording. (2) An association that acquires a mobile home park pursuant to s. 723.071 is exempt from s. 719.1035 and the requirements of part VI of chapter 718 and part VI of chapter 719.
Florida Statute § 723.073 governs what happens when a mobile home park residents' association acquires the park and then plans to transfer portions of it back to individual members. Before any such transfer can occur, the association must file its governing documents—articles, bylaws, and any related covenants or restrictions—with the circuit court clerk. If the association intends to form a cooperative, it must also record the required cooperative documents under Chapter 719, and the cooperative's legal existence begins on the date of that recording. Associations that acquire a park under § 723.071 receive a specific exemption from certain disclosure and conversion requirements otherwise imposed by Chapters 718 and 719.
Plain English — not legal advice.
Under Fla. Stat. § 723.073, an association acting as a property owner after acquiring a mobile home park generally ensures that all governing documents—articles of incorporation, bylaws, and any covenants or declarations of servitude—are recorded with the circuit court clerk before conveying any portion of the property to individual members. Operators forming a cooperative structure also record the cooperative documents in the appropriate county, as Chapter 719 requires, establishing the cooperative's legal effective date at the moment of recording. Associations that acquired the park through the process outlined in § 723.071 should be aware of the statutory exemptions from certain Chapter 718 and Chapter 719 requirements that apply to their situation.

Fla. Stat. § 723.073 provides residents who are members of an association that has purchased their mobile home park with the assurance that governing documents must be publicly recorded before any portion of the park can be transferred to individual members. This recording requirement means tenants-turned-members can review the articles, bylaws, covenants, and restrictions that will govern their ownership rights at the circuit court clerk's office. Residents with questions about whether their association has complied with § 723.073's recording requirements may wish to consult a tenant-rights organization or review the public records at the county clerk's office to verify that the required filings were made before any conveyance occurred.
