Fla. Stat. § 723.001 et seq. § 723.043
Purchase of equipment.
Operative Text
No mobile home park owner or developer shall require a mobile home owner of the mobile home park to purchase from such mobile home park owner underskirting, equipment for tying down a mobile home, or any other equipment required by law, local ordinance, or regulation of the mobile home park. However, the park developer or park owner may determine by rule or regulation the style or quality of such equipment to be purchased by the mobile home owner from the vendor of the mobile home owner’s choosing, provided the style or quality has been disclosed in the prospectus given by the park developer or park owner to the mobile home owner.
Under Florida Statute § 723.043, mobile home park owners and developers are prohibited from requiring residents to buy underskirting, tie-down equipment, or other legally required equipment exclusively from the park itself. While the park may set standards for the style or quality of such equipment, residents retain the right to purchase qualifying equipment from any vendor they choose. Any style or quality requirements the park imposes must have been disclosed in the prospectus provided to the mobile home owner.
Plain English — not legal advice.
Florida Statute § 723.043 means that compliant park operators do not mandate that residents purchase underskirting, tie-down equipment, or similar required items through the park or any single designated vendor. Operators who wish to set style or quality standards for such equipment generally ensure those standards are clearly spelled out in the prospectus delivered to residents before or at the time of occupancy. Keeping prospectus disclosures current and accurate with respect to any equipment specifications is a common practice for operators seeking to stay within the bounds of this provision.

Florida Statute § 723.043 gives mobile home residents the right to shop for underskirting, tie-down equipment, and other required equipment from any vendor they choose, free from a park owner's mandate to buy from the park itself. If a park is requiring residents to purchase such items exclusively through the park, that practice may constitute a violation of this provision, and residents can look into filing a complaint with the Florida Division of Florida Condominiums, Timeshares, and Mobile Homes or reaching out to a tenant-rights organization familiar with mobile home park law. Reviewing the prospectus you received at move-in can help clarify whether any style or quality requirements were properly disclosed as required under § 723.043.
