Fla. Stat. § 723.001 et seq. § 723.023
Mobile home owner’s general obligations.
Operative Text
A mobile home owner shall: (1) At all times comply with all obligations imposed on mobile home owners by applicable provisions of building, housing, and health codes, including compliance with all building permits and construction requirements for construction on the mobile home and lot. The home owner is responsible for all fines imposed by the local government for noncompliance with any local codes. (2) At all times keep the mobile home lot that he or she occupies clean, neat, and sanitary, and maintained in compliance with all local codes. (3) At all times comply with properly promulgated park rules and regulations and require other persons on the premises with his or her consent to comply with such rules and to conduct themselves, and other persons on the premises with his or her consent, in a manner that does not unreasonably disturb other residents of the park or constitute a breach of the peace. (4) Receive written approval from the mobile home park owner before making any exterior modification or addition to the home. (5) When vacating the premises, remove any debris and other property of any kind which is left on the mobile home lot.
Florida Statute § 723.023 sets out the general ongoing obligations that mobile home owners must meet while occupying a lot in a mobile home park. These obligations include keeping the lot clean and code-compliant, following park rules, obtaining written park-owner approval before making exterior changes to the home, and removing all debris and personal property when vacating. The home owner—not the park—bears responsibility for any fines a local government imposes for code violations on the lot or home.

Under Fla. Stat. § 723.023, park operators can expect mobile home owners to maintain their lots and comply with applicable building, housing, and health codes at their own expense, including responsibility for any resulting government fines. A compliant park operator keeps written records of any exterior-modification approvals granted, since the statute requires the home owner to obtain that written consent before making changes. Park operators also generally document their rules and regulations clearly so that the conduct and compliance obligations referenced in § 723.023 are well understood by all residents.

Fla. Stat. § 723.023 defines the affirmative duties mobile home owners carry, including lot upkeep, code compliance, adherence to park rules, and obtaining written approval for exterior modifications. Understanding these obligations can help a mobile home owner recognize when a fine or notice of violation is properly directed at them versus when a dispute may involve the park's own responsibilities under other provisions of Chapter 723. Tenants who have questions about whether a specific obligation or fine is being applied correctly may consult a tenant-rights organization or review the Florida Mobile Home Act for the full framework of rights and duties.
