Fla. Stat. § 723.001 et seq. § 723.014
Failure to provide prospectus or offering circular prior to occupancy.
Operative Text
(1) If a prospectus or offering circular was not provided to the prospective lessee prior to execution of the lot rental agreement or prior to initial occupancy of a new mobile home, the rental agreement is voidable by the lessee until 15 days after the receipt by the lessee of the prospectus or offering circular and all exhibits thereto. (2) To cancel the rental agreement, the mobile home owner shall deliver written notice to the park owner within 15 days after receipt of the prospectus or offering circular and shall thereupon be entitled to a refund of any deposit together with relocation costs for the mobile home, or the market value thereof including any appurtenances thereto paid for by the mobile home owner, from the park owner.
Under Florida Statute § 723.014, a lot rental agreement for a mobile home park is not automatically binding on the tenant if the park owner failed to provide a prospectus or offering circular before the lease was signed or before the tenant first moved in. The lessee retains the right to void the agreement for up to 15 days after finally receiving the prospectus and all its exhibits. If the lessee exercises that right within the window, the park owner is required to refund any deposit and cover relocation costs for the mobile home, or its market value including any appurtenances the mobile home owner paid for.

Under Fla. Stat. § 723.014, compliant mobile home park operators deliver a complete prospectus or offering circular—along with all required exhibits—to every prospective lessee before the lot rental agreement is signed or before the new resident takes initial occupancy. Operators who fail to do so expose themselves to the agreement being voided at the lessee's election, along with an obligation to refund deposits and pay relocation costs or market value of the mobile home. Maintaining documented proof of timely delivery is a standard practice among operators seeking to demonstrate compliance with this provision.

Florida Statute § 723.014 gives mobile home lessees a meaningful protection: if you never received a prospectus or offering circular before signing your lot rental agreement or moving in, your rental agreement may be voidable at your option. You have up to 15 days after you actually receive the prospectus and all its exhibits to deliver written notice of cancellation to the park owner, at which point you would be entitled to a deposit refund and relocation costs or the market value of your mobile home. Tenants who believe this provision applies to their situation may wish to contact a tenant-rights organization, a legal aid office, or the Florida Department of Highway Safety and Motor Vehicles for general information about mobile home park rights.
