Fla. Stat. § 723.001 et seq. § 723.013
Written notification in the absence of a prospectus.
Operative Text
A mobile home park owner who enters into a rental agreement in which a prospectus is not provided shall give written notification to the mobile home owner of the following information prior to occupancy: (1) The nature and type of zoning under which the mobile home park operates; the name of the zoning authority which has jurisdiction over the land comprising the mobile home park; and a detailed description containing all information available to the mobile home park owner, including the time, manner, and nature, of any definite future plans which he or she has for future changes in the use of the land comprising the mobile home park or a portion thereof. (2) The name and address of the mobile home park owner or a person authorized to receive notices and demands on his or her behalf. (3) All fees and charges, assessments, or other financial obligations not included in the rental agreement and a copy of the rules and regulations in effect.
Florida Statute § 723.013 requires mobile home park owners to provide written notice to mobile home owners before occupancy whenever a formal prospectus is not part of the rental agreement. This notice must cover three categories of information: zoning details and any known future plans for the land, the name and address of the owner or their authorized representative, and all fees, charges, assessments, or financial obligations not already spelled out in the rental agreement along with a copy of the park's rules and regulations. The provision ensures that mobile home owners have access to material information about the park's legal status, ownership, and financial expectations before they move in.
Plain English — not legal advice.
Under Fla. Stat. § 723.013, operators who rent without providing a prospectus are expected to prepare a written disclosure document and deliver it to each incoming mobile home owner before occupancy begins. A compliant operator typically documents the park's zoning classification, the name of the governing zoning authority, any known future land-use changes with as much detail as available, and the full name and address of the owner or designated agent for notices. The written notification also includes a complete accounting of all fees and financial obligations not covered in the rental agreement, along with a current copy of the park's rules and regulations.

Fla. Stat. § 723.013 gives mobile home owners the right to receive written notification covering zoning status, ownership contact information, and all financial obligations before they begin occupying a space in a park that does not provide a prospectus. If this written notification was not delivered prior to occupancy, that omission may be relevant to any dispute about the terms of the tenancy or undisclosed fees. Mobile home owners who believe this disclosure was not properly provided can consult a tenant-rights organization, a legal aid office, or review complaint options available through Florida's mobile home regulatory framework.
