14 DCMR § 14-4716
APPLICABILITY OF RULES
Operative Text
4716.1 Portions of this chapter shall apply to a sale of a housing accommodation for which a contract had not been fully executed prior to June 3, 1980; or where a third party contract had been fully executed prior to June 3, 1980, and the period of tenant contracting pursuant to the Rental Housing Act had not expired prior to August 10, 1980. The regulations which shall apply in these instances are §§ 4711.1, 4711.5, 4711.6, 4711.11, 4711.12, 4711.13, 4712, 4713.2, 4713.3, 4714.3, 4714.4, 4715.7, 4715.8 and 4715.9. 4716.2 An owner of a housing accommodation shall comply with all provisions of Title IV of the Act if notices of intent to sell pursuant to the Rental Housing Act had not been received at least fifty percent (50%) of the tenants in occupied units by June 3, 1980.
D.C. Mun. Regs. tit. 14 § 14-4716 establishes which rules governing the sale of housing accommodations apply based on the timing of contract execution and tenant notification relative to two key dates: June 3, 1980, and August 10, 1980. If a sale contract was not fully executed before June 3, 1980, or if a third-party contract was executed before that date but the tenant contracting period under the Rental Housing Act had not yet expired by August 10, 1980, a specific set of regulatory sections continues to govern that transaction. Additionally, if fewer than half of the tenants in occupied units had received notices of intent to sell by June 3, 1980, the property owner is required to comply with all provisions of Title IV of the Act.

Property owners and managers dealing with sales of housing accommodations in the District of Columbia should be aware that § 14-4716 ties compliance obligations directly to the timing of contract execution and tenant notification. Under § 14-4716.2, full compliance with Title IV of the Act is required when notices of intent to sell had not reached at least 50% of tenants in occupied units by June 3, 1980. Operators handling transactions that fall within these historical thresholds generally ensure that the specific regulatory sections enumerated in § 14-4716.1 are followed throughout the sale process.

Section 14-4716 of the D.C. Municipal Regulations provides tenants with protections tied to whether proper notice of a housing accommodation's sale was delivered to a sufficient share of occupants before June 3, 1980. Tenants in buildings where fewer than half of occupied units received notices of intent to sell by that date may have grounds to assert that the owner was obligated to comply with all of Title IV of the Act. Tenants who believe these procedural requirements were not met can explore their options by contacting a tenant-rights organization or consulting the District of Columbia's housing regulatory resources for guidance on raising such issues.
