14 DCMR § 14-3930
ATTORNEY’S FEES-RENT ADMINISTRATOR
Operative Text
3930.1 A prevailing party in a contested case may be awarded attorney’s fees for work performed while a matter is pending before the Rent Administrator and Rental Accommodations Division, in accordance with § 3825. 3930.2 A motion for attorney’s fees shall be filed with the Office of Administrative Hearings or the Commission, as applicable.
Under D.C. Mun. Regs. tit. 14 et seq. § 14-3930, when a contested case is resolved before the Rent Administrator and Rental Accommodations Division, the party that prevails may be awarded attorney's fees for legal work performed during that proceeding, consistent with § 3825. This provision recognizes that litigation costs can be shifted to the losing side in qualifying administrative disputes. Any motion seeking such fees must be filed with either the Office of Administrative Hearings or the Commission, depending on where the matter is being handled.
Plain English — not legal advice.
Property owners and managers involved in contested cases before the Rent Administrator should be aware that D.C. Mun. Regs. tit. 14 et seq. § 14-3930 allows the prevailing party—which could be either side—to seek an award of attorney's fees. Operators who participate in these proceedings generally keep thorough records of legal work performed, since fee motions must be filed with the appropriate body, either the Office of Administrative Hearings or the Commission. Understanding this fee-shifting framework is part of managing the financial exposure associated with administrative rent disputes in the District.
