D.C. Code tit. 8 § 8-241.02
Indoor mold assessment and remediation standards.
Operative Text
(a) Consistent with applicable U.S. Environmental Protection Agency or U.S. Department of Labor, Occupational Safety and Health Administration guidelines and regulations relating to the assessment and remediation of mold, the Director shall: (1) Set a threshold level of indoor mold contamination that requires professional indoor mold remediation at residential properties; (2) Establish scientific and objective methods to be used by individuals certified by the District when conducting an indoor mold assessment; (3) Establish minimum performance standards and work practices for conducting professional indoor mold remediation in the District; and (4) Establish guidelines for the removal of indoor mold below the threshold set by paragraph (1) of this subsection. (b) When professional indoor mold remediation is required under § 8-241.04 because a professional indoor mold assessment found indoor mold contamination at a property, the Director may require the property owner to provide a remediation report from an indoor mold remediation professional to the tenant and to the Department of the Environment.
D.C. Code § 8-241.02 directs the District's Director to establish a science-based framework for addressing indoor mold in residential properties. This includes setting a contamination threshold that triggers the need for professional remediation, defining certified assessment methods, and creating minimum performance standards for remediation work. The provision also gives the Director authority to require property owners to submit a formal remediation report to both the tenant and the Department of the Environment when professional remediation is ordered under § 8-241.04.

Under D.C. Code § 8-241.02, property owners in the District operate within a regulatory framework that sets specific thresholds and standards for indoor mold assessment and remediation. Compliant operators generally ensure that any mold assessment is conducted by District-certified individuals using the methods established by the Director, and that any required remediation meets the minimum performance standards set under this provision. When professional remediation is triggered under § 8-241.04, operators are generally expected to provide a remediation report from a qualified professional to both the affected tenant and the Department of the Environment.

D.C. Code § 8-241.02 establishes the regulatory standards that govern how indoor mold must be assessed and remediated in residential properties in the District. When a professional assessment finds contamination at or above the threshold set under this provision, tenants have a right to receive a remediation report from the property owner's remediation professional, as may be required by the Director. Tenants who believe these standards are not being followed may consider contacting the District's Department of the Environment, consulting a tenant-rights organization, or exploring whether a violation of § 8-241.02 or related provisions may be raised in a housing proceeding.
