D.C. Code tit. 8 § 8-231.18
Rulemaking.
Operative Text
(a) Except as otherwise provided, the Mayor, pursuant to subchapter I of Chapter 5 of Title 2 [ § 2-501 et seq.], may issue rules to implement the provisions of this subchapter. (b) Notwithstanding the requirements of § 2-552(c) , where the Mayor chooses to adopt a federal regulation as the District’s standard under this subchapter, the Mayor may do so by incorporating the federal regulation by reference in the Notice of Intent to take rulemaking action. When incorporating the federal regulation by reference, the notice shall include a specific indication of how and where a paper or electronic copy of such document may be inspected or obtained. Any amendments to the incorporated federal rules shall be deemed to be included in the District’s rules; provided, that after the initial adoption of the federal regulation, the Mayor shall annually issue a Notice of Intent to re-adopt the federal standard, in whole or in part, or announce an intent to adopt a different standard.
D.C. Code § 8-231.01 et seq. § 8-231.18 grants the Mayor authority to issue rules implementing the District's lead-paint and indoor environment subchapter, following the standard rulemaking process. It also creates a streamlined path for adopting federal regulations as District standards by incorporating them by reference, with a requirement that any such adoption be renewed annually. Automatic updates to incorporated federal rules apply, but the Mayor must each year signal whether to re-adopt, partially adopt, or replace the federal standard.
Plain English — not legal advice.
Property owners and managers subject to the District's lead-paint and indoor environment requirements should be aware that the applicable standards can change when the Mayor exercises rulemaking authority under D.C. Code § 8-231.01 et seq. § 8-231.18. Because federal regulations may be incorporated by reference and updated automatically, compliant operators generally monitor annual Notices of Intent issued by the Mayor to track whether the governing standard has shifted. Staying current with those notices helps operators understand which federal or District-specific rules apply to their properties at any given time.

D.C. Code § 8-231.01 et seq. § 8-231.18 shapes the regulatory framework that protects residents from lead-paint and related indoor environmental hazards by defining how the Mayor sets and updates applicable standards. Because the governing rules can be updated annually—either by re-adopting federal standards or by moving to a different standard—tenants benefit from knowing which version of the rules is currently in effect. Tenant-rights organizations and the District's relevant agencies can help residents understand the current standards and any enforcement options available under the subchapter.
